THE PROMOTION
1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in the Photography Masterclass and Tour promotion (“Promotion”) is deemed acceptance of these Terms and Conditions.
2.The Promoter is FUJIFILM Australia Pty Ltd (ABN 80 000 064 433) of Level 2, 54 Waterloo Road, Macquarie Park, NSW 2113 (“Promoter”).
ELIGIBILITY
3. The Promotion is only open to residents of Australia aged 18 years or over, except:
(a) employees of the Promoter or its holding or subsidiary companies;
(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Promotion or its administration; or
(c) members of the immediate families or households of (a) or (b) above.
4. By entering the Promotion, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the Promotion.
HOW TO ENTER
5. The Promotion will run from 9am Monday 2nd November 2020 to 5pm AEDST Friday 13th November 2020 inclusive (“Promotional Period”).
6. To be eligible to enter, individuals must take a landscape photograph. The photograph can depict any type of landscape provided that it complies with these Terms and Conditions.
7. To enter individuals must, during the Promotional Period, undertake the following steps:
a) Visit Bridge Climb Sydney
b) Follow the prompts to the Promotion entry page and complete all the personal entry information requested, including name, Australia residential address, email address and confirmation of age eligibility;
c) Upload their photograph;
d) Provide a description of the photograph; and
e) Submit the fully completed entry form.
LIMIT ONE (1) ENTRY PER PERSON.
8. When an entrant submits any materials as part of the Promotion, including photographs (“Content”), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to:
(a) use and reproduce such Content to the extent necessary to conduct the Promotion and judge the entrant’s entry (provided that it is a valid entry); and
(b) use, reproduce, modify, adapt, publish and display the Content in any media without the prior written consent of the entrant, without compensation, restriction on use, attribution or liability.
The entrant agrees not to assert any moral rights in relation to any of the uses described in this clause 8. The entrant warrants that he or she has the full authority to grant these rights. The entrant agrees that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for any such Content to the full extent permitted by law. The Promoter will pre-moderate all Content and may, subject to the terms of this clause 8, post the Content in various media or remove any Content without notice for any reason whatsoever. The entrant warrants and agrees that:
(i) he or she will not submit any Content that is unlawful or fraudulent, or that is in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
(ii) his or her Content shall not contain viruses or cause injury or harm to any person or entity;
(iii) his or her Content must not have been used in any other competition or promotion or previously released to the general public;
(iv) his or her Content will not depict any dangerous or illegal activity; and
(v) he or she will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
Without limiting any other terms herein, the entrant indemnifies the Promoter for any breach of these Terms and Conditions.
9. By submitting a Promotion entry, entrants are agreeing to be bound by these terms and conditions.
10. The Promotion is not in any way sponsored, endorsed or administered by, or associated with any social network or external website where it is promoted. You are providing your information to the Promoter and its associated agencies who are professionally connected with the Promotion or its administration, and not to any other party.
11. There is a limit of one (1) entry to the Promotion per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
12. The Promoter reserves all rights to disqualify any entrant whose conduct is contrary to the spirit or intention of the Promotion or if it is suspected that an image submitted is not the entrant’s own.
13. All entrants must have internet access in order to enter the Promotion. The Promotion is otherwise free to enter, and no purchase is necessary.
JUDGING
14. All valid entries will be judged based on their creative merit. The Promoter reserves the right to select reserves based on creative merit and use them as replacements in the event that any original entry selected is deemed invalid or the original prize remains unclaimed.
WINNERS
15. The best entry, as determined by the judges, will win a full day photography masterclass and tour for two (2) people presented by professional landscape photographer, Glenn McKimmin, at the Sydney Harbour Bridge on Friday 11th December 2020 valued at $1,990. The second-best entry, as determined by the judges, will win a half day photography masterclass and tour for two (2) people presented by Glenn McKimmin at the Sydney Harbour Bridge on Thursday 10th December 2020 valued at $790. 16. Limit one (1) prize per person.
17. The winners will be notified via email on Monday 23rd November 2020.
18. The decision of the Promoter is final and no correspondence or discussion will be entered into.
19. Prizes are not transferrable or exchangeable and non-cash prizes are not redeemable for cash.
CLAIMING THE PRIZE
20. In order to claim the prize, the winners are required to provide the Promoter with their full name, email address and Australia postal address.
21. So long as the response in paragraph 20 is received, the prize will be delivered free of charge in accordance with the Promoter’s usual delivery terms.
22. The prize may not be claimed by a third party on the winner’s behalf.
23. The Promoter will make all reasonable efforts to contact the winners. In the event that a winner fails to respond to the Promoter to confirm their acceptance of the prize within seven (7) days of being notified by the Promoter, then the prize will be forfeited and the Promoter will be entitled to allocate the prize to the highest-ranking reserve winner in accordance with the process described in paragraph 14 above.
24. The winners are solely responsible for all costs they may be required to incur to take up the prize, including any travel and accommodation costs. The Promoter does not accept any responsibility if any of the winners are not able to take up the prize.
GENERAL
25. Incomplete, indecipherable, or illegible entries will be deemed invalid.
26. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
27. This Promotion is a game of skill and chance plays no part in determining the winners.
28. If the prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
29. The Promoter reserves the right, at any time, to verify the validity of entries (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
30. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
31. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to: (a) disqualify any entrant; or (b) modify, suspend, terminate or cancel the Promotion, as appropriate.
32. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the internet service provider used.
LIMITATION OF LIABILITY
33. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury or any other loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of or connected with the Promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence) for any personal injury or any other loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of or connected with: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry, prize or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner; or (f) use of a prize.
35. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this information. The Promoter may also use the personal information for purposes set out in its privacy policy located on the Promoter’s website (see www.fujifilm.com.au/terms-and-conditions/privacy-policy). The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. All entries become the property of the Promoter.
